Please read these Terms and Conditions ("Terms") carefully before using DuchessDraft ("Service"), operated by HerSport Gaming, Inc. ("Company", "We", "Us", or "Our").
By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service.
You must be at least 13 years of age to use the Service. By using the Service, You represent that You are at least 13 years old. If You are under 18, You represent that You have obtained parental or guardian consent to use the Service.
When You create an account, You must provide accurate, complete, and current information. You are responsible for safeguarding Your password and for all activities that occur under Your account.
You may not use as a username the name of another person, a name or trademark subject to the rights of another person without authorization, or a name that is offensive, vulgar, or obscene. We reserve the right to change or remove usernames that violate these rules.
You must notify Us immediately of any unauthorized use of Your account.
DuchessDraft is a fantasy sports platform for women's basketball. The Service allows You to create and join fantasy leagues, draft players, set lineups, make trades, claim players off waivers, and compete against other users based on real-world player performance statistics.
DuchessDraft is not gambling. The Service does not involve real-money wagering, betting, or monetary prizes. Fantasy leagues, bracket predictions, and pools on DuchessDraft are for entertainment purposes only. No entry fees are charged for league or pool participation beyond the optional DuchessDraft+ subscription.
The Service may offer bracket prediction features for basketball tournaments. Bracket predictions are for entertainment purposes only and do not constitute gambling or wagering of any kind.

By using the free tier of the Service, You agree that advertisements will be displayed within the app. Ads are served by Google AdMob and may be personalized based on Your preferences and usage, subject to Your App Tracking Transparency choices. See our Privacy Policy for details on data collection related to advertisements.

The following terms apply to subscriptions purchased through the Apple App Store:
All subscription payments are processed by Apple. Refund requests must be submitted to Apple through their standard refund process. The Company does not process refunds directly for in-app subscriptions.

Violation of these conduct rules may result in warnings, temporary suspension, or permanent termination of Your account at Our sole discretion.
The Service and its original content, features, and functionality (excluding content provided by users) are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other laws.
The DuchessDraft name, logo, and brand assets are trademarks of HerSport Gaming, Inc. You may not use them without Our prior written consent.
Player names, team names, league names (WNBA, Unrivaled, etc.), and related marks are the property of their respective owners and are used in the Service for informational and entertainment purposes.
If You provide feedback, suggestions, or ideas about the Service, You grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and distribute such feedback without restriction or compensation.
The Service may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
We may terminate or suspend Your account immediately, without prior notice or liability, if You breach these Terms, engage in conduct harmful to other users, or for any other reason at Our sole discretion.
You may delete Your account at any time through the app's Settings or by contacting Us. Upon account deletion, Your right to use the Service ceases immediately. See our Privacy Policy for details on data deletion.
If You have an active DuchessDraft+ subscription, account deletion does not automatically cancel Your subscription. You must cancel Your subscription separately through Apple's subscription management in Your device Settings to avoid continued billing.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure. Fantasy scores, player statistics, and game data are provided for entertainment purposes and may contain errors or delays. We are not responsible for inaccuracies in third-party data sources.
To the maximum extent permitted by applicable law, the Company and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, or other intangible losses, resulting from:
In no event shall the Company's total liability exceed the amount You have paid to the Company through the Service in the 12 months preceding the claim, or $100 USD, whichever is greater.
These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law provisions. Your use of the Application may also be subject to other local, state, national, or international laws.
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting Us at support@duchessdraft.com. If the dispute cannot be resolved informally within 30 days, either party may pursue formal resolution in the courts of Ames, Iowa.
If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
We reserve the right to modify these Terms at any time. If a revision is material, We will provide at least 30 days' notice prior to the new terms taking effect by posting a notice within the app or by other reasonable means. By continuing to access or use the Service after the revised Terms become effective, You agree to be bound by the updated Terms.
